Liberal Judge Refused To Throw Out A Conviction Against Joe Arpaio Ignoring Trumps Pardon

A liberal activist judge refused to throw out a conviction against Joe Arpaio, the former Maricopa County Sheriff. Last month he was pardoned by President Trump, but now the judge requested that Justice Department and Arpaio as well, should convince her.

In a filing Thursday, U.S. District Judge Susan R. Bolton wrote she wasn’t convinced that she could scrub the guilty verdict from Arpaio’s record. Instead, she signaled she was considering simply dropping the criminal case but letting the conviction stand — unless the government can persuade her otherwise.

John F. Banzhaf III who works as a professor of public interest law at the George Washington University Law School thinks this move is due to the heavy-handed judicial activism of as he is referring to as “Trump law.”

It’s “a method of judging cases which is aimed specifically at countering some of the practices of President Trump, even if this development means creating new legal principles and/or overlooking (or at least minimizing) other established ones,” he stated for LawNewz.

Arpaio’s attorneys requested Bolton to drop the case and to dismiss the conviction of willfully ignoring a federal judge’s order and enforcing the immigration laws.

The Trump administration joined in the effort to dismiss this case by demanding “the court vacate its ruling and all other rulings in the case.”

Bolton denied their requests and now is flying in the face “of a 1925 Supreme Court decision which unanimously upheld a presidential pardon for a criminal contempt of court sentence; exactly the unusual type of pardon involved here,” as Banzhaf stated.

Bolton also didn’t comply with the common procedure.

“The Government appears to agree with the Defendant, but furnishes no authority conferring so broad a scope to orders of vacatur issued under similar circumstances,” she stated Thursday.

Judge Bolton was nominated to her position by ex-President Bill Clinton in 2000. However, she obviously doesn’t know what is constitutional law. If she knew it, she wouldn’t act like this.
